Your personal data will not be transmitted to third parties or used for advertising purposes without your consent.

2. Protection of personal data

All personal data that we receive via our website or in e-mail correspondence is secure. To prevent loss or misuse of the personal data stored by us, we take extensive technical and operational security precautions, which are regularly reviewed and adapted to technological progress. However, due to the structure of the Internet, it is possible that data protection regulations and security measures may not be observed by other persons or institutions outside our sphere of responsibility. In particular, unencrypted personal data (e.g. in an e-mail) can be read by third parties. It is therefore the responsibility of the respective user to protect the personal data he or she provides against misuse by encrypting it or in any other way.

3. Cookies

Our website partly uses so-called cookies. Cookies do not cause any damage to your device and do not contain viruses. Cookies serve to make our offer more user-friendly, more effective and safer. Cookies are small text files that are stored on your device and saved by your browser.

After your visit to our website, the cookies are stored for 90 days, unless you delete the cookies beforehand. This allows us to recognize your browser the next time you visit.

You can also set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general or activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of our website may be limited.

4. Server log files

The provider of our website automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • browser type/browser version
  • Operating system used
  • referrer URL
  • IP address of the accessing computer
  • Time of the server request

This data cannot be assigned to specific persons. This data is not merged with other data sources. We reserve the right to check this data retrospectively if we become aware of concrete indications of illegal use.

5 Google Analytics

We do not create a personal user profile of you. In connection with the retrieval of the information requested by you, data is only stored on our servers in anonymized form for the provision of our various services (see also No. 3) or for evaluation purposes. Here, general information is logged, e.g. when which content from our offer is called up or which pages are visited most frequently. All of this anonymously collected usage data is not merged with any other personal data you may have provided to us and is deleted immediately after the end of the statistical evaluation.

To perform the analysis, we use Google Analytics, a web analytics service provided by Google Inc (“Google”), 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website is usually transmitted to a Google server in the USA and stored there. The IP address transmitted by your browser as part of Google Analytics is not merged with other data from Google. We have also extended Google Analytics on this website with the code “anonymizeIP”. This guarantees the masking of your IP address so that all data is collected anonymously. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there.

Google will use the information collected on our behalf for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to us. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website.

You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) to Google, as well as the processing of this data by Google, by downloading and installing the browser add-on available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

6. hyperlinks to third party websites

We assume no responsibility or liability for the confidential handling of your (personal) data by providers of other websites, as we neither know their data protection regulations nor have any influence on compliance with them.

a. Our website uses a “social media button” of the social network Facebook. The provider is Facebook Inc, 1 Hacker Way, Menlo Park, CA 94025, USA. You can recognize the social media button (plug-in) by the Facebook logo or the “Like” button (“Like”) on our website. You can find an overview of the Facebook plug-ins here: http://developers.facebook.com/docs/plugins/.

When you visit our website, a direct connection is established between your browser and the Facebook server via the plug-in. Facebook thereby receives the information that you have visited our website with your IP address. If you click on the plug-in, you will be redirected to our user account on Facebook in a separate browser window and can – provided you are logged into your user account on Facebook – share or subscribe to our news, among other things. In addition, it is then possible for Facebook to associate your visit to our website – provided you are logged into your user account on Facebook – with you and your user account. We point out that we have no knowledge of the content of the transmitted (personal) data and their use by Facebook. For more information, please see Facebook’s privacy policy at: http://de-de.facebook.com/policy.php

If you do not want Facebook to be able to associate your visit to our website with your user account on Facebook, please log out of your user account.

b. Our website also uses a “social media button” of the LinkedIn network. The provider is LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA.

Each time you call up our website, a connection is established to the LinkedIn servers. LinkedIn is then informed that you have visited our website with your IP address. If you click on the social media button (plug-in), you will be redirected to our user account at LinkedIn in a separate browser window and can there – provided you are logged into your user account at LinkedIn – share or subscribe to our news, among other things. In addition, it is then possible for LinkedIn to associate your visit to our website – provided you are logged into your user account on LinkedIn – with you and your user account. We point out that we have no knowledge of the content of the transmitted (personal) data and its use by LinkedIn. For more information, please refer to LinkedIn’s privacy policy at: https://www.linkedin.com/legal/privacy-policy.

If you do not want LinkedIn to be able to associate your visit to our website with your user account on LinkedIn, please log out of your user account.

c. Our website also uses a “social media button” of the XING network. The provider is XING AG, Dammtorstraße 29-32, 20354 Hamburg, Germany.

Each time our website is called up, a connection to the XING servers is established. As far as we are aware, no personal data is stored in the process. In particular, no IP addresses are stored or usage behavior evaluated. If you click on the social media button (plug-in), you will be redirected to our user account on XING in a separate browser window and can share or subscribe to our news there, among other things – provided you are logged into your user account on XING. You can find more information on this in the XING privacy policy at: https://www.xing.com/app/share?op=data_protection.

In addition, publications, news and events made available and announced on our website contain hyperlinks to websites of other providers. For information on the handling of your (personal) data by providers of other websites, please read the respective privacy policies

7. Newsletter

a. Information about the newsletter and consent

With the following information, we inform you about the contents of our newsletter as well as the registration, dispatch and statistical evaluation procedure and your rights of objection. By subscribing to our newsletter, you agree to receive it and to the procedures described.

b. Content of the newsletter

We send newsletters, e-mails and other electronic notifications with promotional information (hereinafter “newsletter”) only with the consent of the recipients or a legal permission. Insofar as the contents of the Newsletter are specifically described in the context of a registration, they are decisive for the consent of the users. In addition, our newsletters contain information on legal topics, in particular from the area of marketing law, data protection as well as our law firm (this may include, in particular, references to blog articles, lectures or workshops, our services or online presences).

c. Double-Opt-In and Logging

Registration for our newsletter takes place in a so-called double opt-in process. This means that after registration you will receive an e-mail asking you to confirm your registration. This confirmation is necessary so that no one can register with other e-mail addresses.

The registrations for the newsletter are logged in order to be able to prove the registration process according to the legal requirements. This includes the storage of the registration and confirmation time, as well as the IP address.

d. Use of the “MailChimp” dispatch service provider

The newsletter is sent using “MailChimp”, a newsletter sending platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.

The email addresses of our newsletter recipients, as well as their other data described in the context of these notes, are stored on MailChimp’s servers in the USA. MailChimp uses this information to send and evaluate the newsletter on our behalf. Furthermore, according to its own information, MailChimp may use this data to optimize or improve its own services, e.g. to technically optimize the dispatch and display of the newsletters or for economic purposes to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to write to them itself or pass the data on to third parties.

We trust in the reliability and IT and data security of MailChimp. MailChimp is certified under the US-EU data protection agreement “Privacy Shield” and thus undertakes to comply with EU data protection requirements. Furthermore, we have concluded a “Data Processing Agreement” with MailChimp. This is a contract in which MailChimp undertakes to protect the data of our users, to process it on our behalf in accordance with its data protection provisions and, in particular, not to pass it on to third parties. You can view MailChimp’s privacy policy here.

e. Registration data

To register for the newsletter, it is sufficient to provide your email address.

f. Statistical collection and analysis

The newsletters contain a so-called “web-beacon”, i.e. a pixel-sized file that is retrieved from the MailChimp server when the newsletter is opened. Within the scope of this retrieval, technical information, such as information about the browser and your system, as well as your IP address and the time of the retrieval are initially collected. This information is used for the technical improvement of the services based on the technical data or the target groups and their reading behavior based on their retrieval locations (which can be determined with the help of the IP address) or the access times.

The statistical surveys also include the determination of whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is neither our endeavor nor that of MailChimp to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.

g. Online calls and data management

There are cases where we direct newsletter recipients to MailChimp’s websites. E.g., our newsletters contain a link that newsletter recipients can use to retrieve the newsletters online (e.g., in case of display problems in the email program). Furthermore, newsletter recipients can subsequently correct their data, such as the e-mail address. Likewise, the privacy policy of MailChimp is only available on their site.

In this context, we pointed out that cookies are used on the websites of MailChimp and thus personal data is processed by MailChimp, their partners and service providers used (e.g. Google Analytics). We have no influence on this data collection. You can find more information in the privacy policy of MailChimp. We also draw your attention to the options for objecting to the collection of data for advertising purposes on the websites http://www.aboutads.info/choices/ and http://www.youronlinechoices.com/ (for the European region).

h. Cancellation/revocation

You can cancel the receipt of our newsletter at any time, i.e. revoke your consent. This will simultaneously terminate your consents to its dispatch via MailChimp and the statistical analyses. A separate revocation of the dispatch via MailChimp or the statistical analysis is unfortunately not possible.

You will find a link to cancel the newsletter at the end of each newsletter.

8. information on stored personal data/deletion

If we have collected personal data from you, we will only store it as long as this is permitted by law. Upon request, we will be happy to inform you which personal data we have stored. If it turns out that, despite our efforts to keep your data correct and up-to-date, we have stored incorrect data, we will correct it immediately. Of course, we will also delete your stored data immediately upon request. If deletion is not possible for legal reasons, the data will be blocked instead. However, we would like to point out that after the deletion of your data, we will only be able to offer our services in part or even not at all.
